Further Clarification on Amendments on the Ballots

Dear Homeowners,


After further clarification from our attorney working on the by-law amendments. We can confirm that each of the amendments that are on your ballot falls into the editorial category. Meaning these changes arise from either board recommendation or homeowner request. None of the current amendments on the ballot are required by law.


As for the additional language that was added to Article VI Section 7 regarding the liability of owners for their pets, this is the attorney's answer for adding that in. “Law provides that owners are responsible for any damage caused by their unit, guests invitees, tenants so this provision just expands what the law already provides that an owner is responsible for regardless of who or what causes the damage. Section 9.1(a) of the IL Condo Act is a strict liability provision and authorizes the association to assess back any damages arising out of the use of one's unit.”


Please discuss the proposed amendments with your household and use your right to vote in favor or against each of the amendments.


If any amendment receives 75% votes in favor, we will work with the attorney and pay the recording fees to finalize the amendment and distribute amend governing documents to all homeowners.
